What Council Permits Do You Need in Melbourne?
Quick answer
Most Melbourne renovations, extensions and custom builds need a building permit, and many also need a planning permit from council. Planning permits deal with land use and development. Building permits confirm the works meet the Building Code of Australia. JSG Construct manages these applications for our clients.
What is the difference between a planning permit and a building permit?
These are two separate processes and many people confuse them.
A planning permit is issued by your local council. It relates to land use and development: what can be built, where and how it relates to the neighbourhood. Not every renovation needs a planning permit, but extensions that exceed certain limits, properties with heritage overlays and developments near neighbourhood character overlays usually do.
A building permit is issued by a registered building surveyor, either council or private. It confirms that the proposed construction meets the Building Code of Australia. Almost all structural work requires a building permit.
When do you need a planning permit in Melbourne?
You generally need a planning permit when your project:
- Exceeds height or setback limits for your zone
- Is on a property with a heritage or neighbourhood character overlay
- Involves subdivision or change of use
- Requires removal of significant vegetation
If you are unsure, your council's planning department can advise, or we can check on your behalf during the pre-construction phase.
How long does the permit process take?
Planning permits can take anywhere from around 60 to 120+ days, depending on the council, the complexity of the application and whether objections are lodged by neighbours. Building permits, through a private surveyor, typically take 2 to 4 weeks once documentation is complete.
Who manages the permit process on your project?
On JSG Construct projects across renovations, extensions and custom builds, we manage permit applications on your behalf. We coordinate with your architect, engineer and the relevant authorities so you do not have to navigate the process alone.
Frequently asked questions
Do all renovations in Melbourne need a permit?
Most structural work needs a building permit. Cosmetic works such as painting or replacing fittings usually do not. Extensions and heritage properties often need a planning permit as well.
Can I start work while I wait for permits?
No. Starting building work without the required permits can lead to enforcement action and complications when selling the property later.
Who applies for the permits, the homeowner or the builder?
Either can, but on JSG Construct projects we typically manage the applications and coordination with council and the building surveyor.
Do custom new builds need a planning permit?
Often yes, particularly where zoning, overlays or neighbourhood character controls apply. This is checked early in pre-construction.
